  • While your account is active, we retain your personal data and communication logs for as long as needed to provide our services.
  • After account deletion, we retain your information for up to 90 days to allow for account restoration, legal obligations, or dispute resolution.
  • Carrier or downstream partners (such as messaging providers or telecom carriers) may retain messaging metadata or logs for up to 13 months unless you request deletion. Such data may persist beyond Branxify’s systems unless specifically purged by your request.
  • Aggregate analytics or anonymized data may be retained longer for internal reporting or service improvement, without identifying you personally.

You may request deletion of your data, including downstream and carrier- held data, via contacting us.

To align with OpenPhone’s Fair Use expectations and carrier compliance practices:

  • You must only send messages with prior clear consent from recipients, including no cold outreach without opt-in.
  • Prohibited content includes, but is not limited to: firearms, gambling, cannabis, pharmaceuticals, adult services, hate speech, phishing, spam, or deceptive/misleading messages.
  • Violation of these rules may result in suspension or termination of account access. Branxify reserves the right to comply with carriers’ enforcement policies. We maintain a compliance review team and offer a dispute resolution process in case of wrongful flags.

15. CORP CHANGE & DATA TRANSFERS

In the event of a merger, acquisition, or sale, personal data may be transferred as part of the transaction. We will notify you in advance and provide options for your data (e.g., opting out or requesting deletion), consistent with OpenPhone-style notification practices.

16. UPDATES TO THIS POLICY

We may revise this policy periodically. Any material changes will be posted with updated revision dates and may be communicated to you directly when necessary.

17. Branxify refund policy will be nil if:

  • The primary design concept has been approved.
  • The cancellation has been made due to reasons non-related to the company.
  • The company has not been contacted for more than 2 weeks of the project.
  • The company’s policies, or policy, have been violated.
  • Another company or designer has been approached for the same project.
  • The creative brief lacks the required information.
  • A complete design change has been demanded.
  • The claim has crossed the given ‘request for refund’ time span.
  • The business is closing or changing its name or business.
  • Reasons such as ‘change of mind,’ ‘disagreement with partner’, or other reasons that do not pertain to the service will not be subject to refund under any circumstances. If a client subscribes to a service bundle and happens to be dissatisfied with a particular service, the refund will only be applicable to that particular service and ‘not’ the entire bundle. The client will not be entitled to any refunds after 15 days of the date of purchase.
